GamJam Competition – Terms and Conditions

These terms and conditions (the ”Agreement”) constitute an agreement by and between yourself (“You”, “Your” or “Participant”, accordingly), and YoYo Games Ltd (“YYG”). This Agreement is supplemental to the YoYo Games Platform User Agreement entered into between You and YYG “License Agreement”). In the event of any conflict or inconsistency between this Agreement and the License Agreement, this Agreement shall prevail with respect to the subject matter hereof. You and YYG may also be referred to herein individually as “Party” and collectively as the “Parties”.
1. The Competition
YYG is holding a competition for UK schools and colleges in which YYG Platforms (as defined the License Agreement) students (Years 9-11 for secondary schools or participating in a course at the enrolled college) working in teams of three are required to create a game (the “Game” and “Developed Game”, respectively), based on a pre-defined theme. The Schools and Colleges will compete in separate categories.
2. Participation criteria and Competition Rules
a. In order to enter the Competition, You must make the game using GameMaker Studio 2 license (“GMS2 License(s)”).
b. Competition is free of charge, and open to any UK school or college.
c. Only one entry per school per category is permitted.
d. The submission of the Developed Game must be made as an attachment to an email, in the format of .yyz, sent to email@example.com , by 12pm, 6 November, 2021, GMT (the “Closing Date”).
e. The winner of the National Competition shall be the user that creates the best Developed Game, as determined by YYG judging panel, in its absolute discretion. Every participating school will be provided with awards which they should make to their own winning students completely at their discretion. YYG takes no responsibility for the selection of each school or college’s winning entry or the distribution of the prizes to the winners by the school or college.
3. The Winner and the Prize
a. The winning school and college of the national competition (the “Winning Education Establishments”) shall win 30 x 2 year GMS2 Achiever licences and a trophy (the “Education Establishment Prizes”). The winning school and college teams of the national competition (the ’Winning Teams’) will receive 3 x 2 year subscriptions to the GameMaker Studio 2 Indie licence, a trophy and certificate.(the “Team Prizes”). The School and College competition winners that are submitted by each school or college (the “Local Winners”) will receive 3 x 1 year GameMaker Studio 2 Indie licences and a certificate provided to the school as a PDF for them to complete. The Winning Education Establishments shall also be announced on YYG’s pages on Facebook and Twitter. The announcement in GameMaker Showcase will also include a feature of the Developed Games.
b. The Educational Establishment Prizes (i) cannot be exchanged for cash and no other alternatives will be offered. In the event of a Prize being unavailable for any reason, YYG reserves the right to determine and substitute a prize of equal or greater value at any time, without notice.The Team Prizes and Local Prizes (i) personal and non-transferable, and (ii) cannot be exchanged for cash and no other alternatives will be offered. In the event of a Prize being unavailable for any reason, YYG reserves the right to determine and substitute a prize of equal or greater value at any time, without notice.
c. The National Winners will be selected and announced within four weeks, following the Closing Date. The Local Winners will be selected and notified by the School or College. YYG takes no responsibility for this process.
d. The Winner shall be notified by email (“Prize Notification”).
e. Prize must be accepted in the manner set out in the Prize Notification. In the event that any Prize Notification is returned as undeliverable or a Prize-winner fails to validly reply to a Prize Notification within 28 days, or rejects the Prize, YYG reserves the right to disqualify the Winner and select an alternative Prize-winner in accordance with the Competition Rules above.
4. Withdrawal or Disqualification
a. YYG reserves the right, in its absolute discretion, to disqualify any Participant for any breach or non-compliance with the competition rules listed herein, this Agreement, the License Agreement and/or any other applicable laws, without providing prior notice to that effect.
b. In the event that the Winner is disqualified from the Competition, YYG shall select an alternative Prize-winner in the same manner as the original Winner and such selection will be subject to the terms hereof.
5. Your obligations:
By entering the Competition, You hereby represent and warrant that on behalf of your school or college:
a. All information submitted by You is true, accurate and complete. YYG reserves the right to verify any information contained in your entry and/or your eligibility to enter the Competition;
b. You are over the age of 16;
c. You shall comply with all laws applicable to this Agreement;
d. You shall not select or use as a username a name of another person with the intent to impersonate that person;
e. You shall not use as a username a name subject to any rights of a person other than You without appropriate authorization and or, use, as a username, a name that is otherwise offensive, vulgar or obscene;
f. You are solely responsible for the activity that occurs in Your account, and for keeping Your account password and login credentials secure. You may never use another person’s user account or registration information to enter the Competition, without permission;
g. You must notify YYG immediately of any change in Your eligibility to participate in the Competition, or breach of security or unauthorized use of Your account.
6. Publicity and data protection
You hereby acknowledge and agree that YYG, and any third party authorized by YYG, have the right to publish the Educational Establishment Winner’s name on both YYG’s internal and external websites as well as in any other activity, for promotional purposes. YYG has the right to use, reproduce, publish, display, transmit, copy, amend or store the Winner’s entry worldwide for such promotional purposes, and for the purposes of the Competition.
7. Disclaimer and Limitation of Liability
a. YYG accepts no responsibility for any damage suffered by any Participant (person, organization or company) resulting from participating in the Competition, including any damages that may be suffered as a result of using the Game and/or developing the Developed Game.
b. YYG accepts no responsibility for entries lost due to computer error in transit.
8. Governing law and jurisdiction:
The Agreement will be governed by the laws of England and Wales. The Parties agree that any claims, legal proceedings, or litigation arising in connection with the Agreement, will be brought solely to the courts of London, England, and the Parties consent to the exclusive jurisdiction of such courts.
